1. About these Terms

1.1

These Terms of Use (the Terms) apply when you use the Autofusion website at autofusionhire.co.uk, our apps and any related services (together, the Platform), and when you make a Booking through the Platform.

1.2

By creating an Account or making a Booking, you agree to these Terms. If you do not agree, please do not use the Platform.

1.3

The following documents also form part of your agreement with us:

  • our Privacy Notice and Cookie Policy;
  • our How We Work page, which explains how listings are ranked, how reviews are handled and how we are paid; and
  • the Booking Confirmation and any information shown to you before you complete your Booking.

1.4

Your hire of the vehicle itself is governed by the Hire Partner's Rental Agreement. Its key terms are shown on the listing and during checkout. If there is a conflict between these Terms and the Rental Agreement about the hire itself, the Rental Agreement applies. These Terms apply to your use of the Platform, the booking process and payment.

1.5

If any part of these Terms is found to be unlawful or unenforceable, the rest will continue to apply.

2. Definitions

2.1

In these Terms:

  • Account means your registered account on the Platform.
  • Autofusion, we, us and our mean Rental Tech Limited, a company registered in Scotland under company number SC896096, with its registered office at 2 Fitzroy place, Sauchiehall street, Glasgow, G3 7RH, trading as Autofusion. VAT number GB 526 660 680
  • Booking means a reservation of a Vehicle made through the Platform.
  • Booking Confirmation means the email we send confirming your Booking.
  • Collection means the handover of the Vehicle to you at the start of the Hire Period, whether at the Hire Partner's premises or by delivery.
  • Hire Partner means the independent hire company or Autofusion franchisee that supplies the Vehicle and with whom you enter into the Rental Agreement.
  • Hire Period means the period from the Collection time to the return time stated in your Booking Confirmation, as varied by agreement.
  • Main Driver means the person whose details are entered as the main driver during the booking process.
  • Named Driver means any additional driver approved by the Hire Partner and named on the Rental Agreement.
  • Rental Agreement means the contract between you and the Hire Partner for the hire of the Vehicle.
  • Security Deposit means the sum held or pre-authorised against your payment card to cover potential charges under the Rental Agreement.
  • Vehicle means the vehicle you book through the Platform.
  • you and your mean the person making the Booking and, where relevant, the Main Driver.

3. About Autofusion and our role

3.1

Autofusion operates the Platform. We allow Hire Partners to list vehicles and allow you to search for, compare, book and pay for vehicle hire.

3.2

Unless we clearly state otherwise for a particular Booking, Autofusion is not the owner or supplier of the Vehicle and is not a party to the Rental Agreement. The Hire Partner is responsible for the Vehicle, its condition, its roadworthiness, its insurance (where included) and the performance of the hire.

3.3

Some Hire Partners are Autofusion franchisees operating under the Autofusion brand in a defined territory. Franchisees are independent businesses. The Hire Partner for each Booking is named on the listing and in your Booking Confirmation.

3.4

Listing information (including vehicle specifications, photographs, availability, prices and policies) is provided by Hire Partners. We take reasonable care in operating the Platform, but we cannot guarantee that all listing information is accurate or complete. We will correct errors promptly once we become aware of them.

3.5

Listing a Vehicle or Hire Partner on the Platform is not a recommendation or endorsement by Autofusion.

3.6

If we help you communicate with a Hire Partner, that does not make us responsible for the Hire Partner's response or for the hire.

4. Using the Platform and your Account

4.1

You must be at least 18 years old to use the Platform. Separate, higher age requirements apply to driving a Vehicle (see section 5).

4.2

You may need to create an Account to make a Booking. You must provide accurate, complete and up-to-date information and keep it updated.

4.3

You are responsible for all activity on your Account. Keep your login details secure and do not share them. Tell us immediately at enquiries@autofusionhire.co.uk if you suspect unauthorised use of your Account.

4.4

The person making the Booking is responsible for ensuring that any other person whose details they provide (including Named Drivers) has agreed to their information being shared with us and the Hire Partner.

4.5

We may change, suspend or withdraw any part of the Platform, for example for maintenance or security reasons. We will try to give notice where reasonably possible.

5. Eligibility and driver requirements

5.1

Driver requirements are set by each Hire Partner and may vary by vehicle. The requirements for each Vehicle are shown on the listing. Unless the listing states otherwise, the Main Driver and every Named Driver must:

  • be at least 25 years old (some high-performance vehicles require drivers to be 30 or older);
  • have held a full, valid driving licence for at least 3 years;
  • have no more than [6] penalty points and no driving convictions for drink or drug driving, dangerous driving or driving while disqualified within the last 5–10 years; and
  • not have been refused motor insurance or had a policy cancelled or special terms imposed in the last 5 years.

5.2

At Collection, each driver must produce their full, valid photocard driving licence and proof of identity and proof of address dated within the last 3 months. The Main Driver must also produce a credit card in their own name with sufficient available funds for the Security Deposit. Debit cards may not be accepted.

5.3

Drivers with a licence issued in Great Britain must provide a DVLA licence check code generated no more than 21 days before Collection. Drivers with a licence issued outside the UK must provide an International Driving Permit where required, together with their passport.

5.4

You must tell us or the Hire Partner as soon as possible, and before Collection, about any penalty points, convictions, medical conditions affecting your ability to drive, or insurance history that may affect eligibility.

5.5

The Hire Partner may refuse to release the Vehicle if any driver does not meet the requirements, cannot produce the required documents, or appears unfit to drive (including through alcohol or drugs). In that case, the refusal is treated as a cancellation by you under the Hire Partner's cancellation policy (section 10).

5.6

Only the Main Driver and Named Drivers may drive the Vehicle.

6. Making a Booking

6.1

When you submit a Booking request, you are making an offer to hire the Vehicle from the Hire Partner on the terms shown. A contract is formed only when we send you a Booking Confirmation. Some Bookings are confirmed instantly; others require the Hire Partner's acceptance, in which case we will not take full payment until the Booking is confirmed.

6.2

Please check your Booking Confirmation carefully and tell us immediately if anything is incorrect.

6.3

Unless the listing states that a specific vehicle is guaranteed, the Hire Partner may provide a vehicle of the same make and model, or of equivalent or higher specification, class and value. Photographs are for illustration. Where a specific vehicle is guaranteed and the Hire Partner cannot provide it, section 10.6 applies.

6.4

Only the Main Driver (or someone the Main Driver has nominated to us in writing) may change or cancel a Booking or discuss it with us.

6.5

We and the Hire Partner may decline any Booking without giving reasons, for example where we cannot verify identity or eligibility, or for fraud-prevention reasons. If we decline a Booking, we will refund any payment taken in full.

7. Prices and fees

7.1

The price shown at checkout includes VAT and all mandatory fees that apply to your Booking as selected. Optional extras, and charges that depend on how you use the Vehicle, are shown separately.

7.2

Charges that may apply in addition to the hire price, depending on the listing and your use of the Vehicle, include:

  • delivery and collection fees;
  • additional driver and young driver fees;
  • excess mileage charges above the included allowance;
  • fuel or electric charging charges if the Vehicle is not returned at the agreed level;
  • cleaning, valeting, smoking or pet-related charges;
  • late return and extension charges;
  • damage, loss and repair costs, up to any excess stated in the Rental Agreement; and
  • fines, penalty charges, tolls and congestion or clean air zone charges, together with any administration fee stated in the Rental Agreement (see section 14).

7.3

Hire is charged in 24-hour periods from the Collection time unless the listing states otherwise.

7.4

Where a price has clearly been shown in error (for example, a vehicle listed at a small fraction of its normal price), we are not obliged to honour it. We will tell you, cancel the Booking and refund you in full.

7.5

Where we show a previous or crossed-out price, it refers to the price of the same Vehicle, for the same dates and on the same terms, without the discount.

8. Payment

8.1

Autofusion accepts payments from you as commercial agent on behalf of the Hire Partner. When you pay us for a Booking, your obligation to pay the Hire Partner for that amount is discharged, and the Hire Partner cannot ask you to pay it again.

8.2

Depending on the listing, you will pay either the full price at the time of Booking or a booking deposit at the time of Booking with the balance due by 7 day before the booking. The payment schedule is shown before you book.

8.3

If a balance payment is not received by the due date, we will try to contact you. If payment is still not made within 48 hours, the Booking may be cancelled and the Hire Partner's cancellation policy will apply.

8.4

Payments are processed by our payment provider, Stripe. We do not store full card details. With your consent, we may store a payment token so you can pay more easily in future.

8.5

If your card is in a different currency from the Booking (GBP), your card issuer may charge foreign exchange or transaction fees. We are not responsible for these.

8.6

If you believe a charge is incorrect, please contact us first so we can investigate (section 23). If you raise a chargeback for a charge that was properly made under these Terms or the Rental Agreement, we or the Hire Partner may provide evidence to your card issuer and may recover the amount and reasonable costs from you.

9. Security deposits

9.1

Most Bookings require a Security Deposit. The amount is shown on the listing and in your Booking Confirmation. For high-value vehicles, the deposit may be substantial.

9.2

The Security Deposit will be pre-authorised or taken from the Main Driver's credit card at Collection by the Hire Partner.

9.3

The Security Deposit may be used to cover any amount you owe under the Rental Agreement, including damage, fuel, excess mileage, cleaning, late return, fines and administration charges.

9.4

Any unused part of the Security Deposit will be released within 7-14 working days after the Vehicle is returned and inspected, unless the Hire Partner has notified a claim. Your card issuer may take longer to make released funds available.

9.5

The Security Deposit is not a limit on your liability. You remain responsible for any amount owed under the Rental Agreement that exceeds it.

10. Cancellations, amendments and no-shows

10.1

Each Hire Partner sets its own cancellation policy. The policy that applies to your Booking is shown on the listing and at checkout, and is confirmed in your Booking Confirmation. By making a Booking, you accept that policy.

10.2

Your right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day cancellation period does not apply to car hire services provided on a specific date or within a specific period. Your right to cancel and any refund are therefore governed by the Hire Partner's cancellation policy.

10.3

No-shows and late Collection. If you do not collect the Vehicle, or you arrive after the Collection time and any grace period stated on the listing, the Hire Partner may treat the Booking as cancelled by you. If you expect to be late, contact the Hire Partner or us as soon as possible.

10.4

Early return. No refund is due for unused time if you collect late or return the Vehicle early, unless the Hire Partner agrees otherwise.

10.5

Changes by you. You may request changes to your Booking through your Account or by contacting us. Changes are subject to availability and the Hire Partner's agreement and may change the price. We will tell you about any price change before it is confirmed. We do not charge an administration fee for changes.

10.6

Changes or cancellation by the Hire Partner or us. If the Hire Partner or we need to make a significant change to your Booking (for example, the Vehicle is unavailable or a guaranteed vehicle cannot be supplied), we will tell you as soon as possible and, where we can, offer an alternative. If you do not accept the change or alternative, you may cancel and receive a full refund of everything you have paid for the Booking, whatever the Hire Partner's cancellation policy.

10.7

Refunds due to you will be made to the original payment method within [14] days.

11. Collection, delivery and return

11.1

You must collect the Vehicle at the time and place shown in your Booking Confirmation, or be available at the delivery address at the agreed time.

11.2

At Collection, you and the Hire Partner should inspect the Vehicle and record its condition, mileage and fuel or charge level, including with dated photographs or video. Check the condition report carefully before signing and raise any existing damage that has not been recorded. We recommend you keep your own photographs.

11.3

You must return the Vehicle at the agreed time and place, in the same condition (fair wear and tear excepted) and with the agreed fuel or charge level. The Vehicle should be inspected on return in the same way as at Collection.

11.4

If you want to extend your hire, you must contact the Hire Partner or us before the scheduled return time. Extensions are subject to availability and additional charges. Returning the Vehicle late without agreement may result in late return charges under the Rental Agreement, and the Hire Partner may take steps to recover the Vehicle.

11.5

Delivery and collection services, where offered, are provided by the Hire Partner and may be subject to additional fees and conditions shown on the listing.

12. Your obligations during the hire

12.1

The Rental Agreement sets out your full obligations. In summary, and unless the Rental Agreement says otherwise, you must not, and must ensure that no driver will:

  • allow anyone other than the Main Driver or a Named Driver to drive the Vehicle;
  • drive under the influence of alcohol or drugs, or otherwise in breach of road traffic law;
  • use the Vehicle for racing, track days, speed trials, rallies, off-road driving, driving tuition or any competitive event;
  • use the Vehicle for hire or reward, ride-sharing, courier or delivery services, or sub-let it to anyone else;
  • use the Vehicle for commercial filming, photography, weddings or events without the Hire Partner's prior written consent;
  • take the Vehicle outside mainland Great Britain without the Hire Partner's prior written consent;
  • smoke or vape in the Vehicle, or carry animals unless the Hire Partner has agreed;
  • modify the Vehicle, remove or interfere with any tracking device, or tow anything with it; or
  • leave the Vehicle unlocked, leave keys in or near the Vehicle, or park it anywhere it is at unreasonable risk of damage or theft.

12.2

You must drive the Vehicle carefully and in accordance with all laws, keep it secure, check warning lights and fluid levels where reasonable, and use the correct fuel.

12.3

Breach of these obligations may make you liable for the full cost of any resulting loss or damage (including where insurance or damage cover would otherwise apply), and may entitle the Hire Partner to end the hire and recover the Vehicle.

13. Damage, accidents, theft and breakdown

13.1

If the Vehicle is involved in an accident, is damaged, stolen or breaks down, or a warning light appears, you must:

  • make sure everyone is safe and call the emergency services where needed;
  • report any accident involving injury, and any theft or vandalism, to the police and obtain a crime or incident reference;
  • contact the Hire Partner immediately using the number in your Rental Agreement or Booking Confirmation;
  • not admit liability or authorise repairs without the Hire Partner's consent;
  • take photographs and collect the names, addresses, insurance and registration details of any third parties and witnesses; and
  • keep all documents and provide them to the Hire Partner, their insurer or us on request.

13.2

Your liability for damage, loss or theft is set out in the Rental Agreement, including any excess and any damage waiver or excess reduction you have purchased.

13.3

Damage claims. If a Hire Partner wishes to charge you for damage or other losses, it must notify you within 14 days of the end of the Hire Period, with supporting evidence (for example, condition reports, photographs and repair estimates or invoices). You will have 7 days to respond. If you dispute the claim, we will review the evidence from both sides and may help the parties reach a resolution. We are not a formal adjudicator, and this process does not affect the legal rights of you or the Hire Partner.

13.4

Charges for damage will be limited to the reasonable cost of repair or replacement (or the applicable excess, where lower), together with any reasonable loss of use and administration charge stated in the Rental Agreement.

14. Fines, penalties and charges

14.1

You are responsible for all fines, penalty charge notices, parking charges, speeding and other traffic offences, tolls, congestion charges, clean air or low emission zone charges and similar charges incurred during the Hire Period.

14.2

Where a notice is issued to the Hire Partner as registered keeper, the Hire Partner may transfer liability to you by providing your details to the issuing authority, or may pay the charge and recover it from you, together with the administration fee stated in the Rental Agreement.

15. Insurance and damage cover

15.1

Details of any insurance included with the Vehicle, including the level of cover and the excess, are provided by the Hire Partner and shown on the listing and in the Rental Agreement.

15.2

Autofusion does not itself provide insurance. If Autofusion arranges or introduces any insurance, excess reduction or damage waiver product, the relevant policy or product terms, and details of the provider and its regulatory status, will be provided to you before purchase. Those terms, not these Terms, govern the product.

15.3

Where a Hire Partner requires you to arrange your own insurance, you must provide valid evidence of cover acceptable to the Hire Partner before Collection.

16. Vehicle tracking and telematics

16.1

Many Vehicles are fitted with tracking or telematics devices that may record location, speed, driving behaviour and vehicle data. The Hire Partner may use this data to protect the Vehicle, recover it if stolen or not returned, investigate accidents, damage or misuse, and enforce the Rental Agreement.

16.2

Where a Vehicle is fitted with such a device, this will be stated on the listing or in the Rental Agreement. More information about how this data is used is in our Privacy Notice and the Hire Partner's privacy information.

17. Reviews and content

17.1

After your hire, you may be invited to leave a review. Reviews must be honest, based on your own genuine experience, and must not contain offensive, defamatory, discriminatory or unlawful content, or personal data about others.

17.2

You must not post, or be paid or rewarded to post, a fake or misleading review. We take steps to check that reviews come from customers who have completed a Booking, and our How We Work page explains how reviews are collected and displayed.

17.3

By submitting a review, photograph or other content, you confirm that you own it or have permission to share it, and you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it on the Platform and in our marketing. You may ask us to remove your content from our marketing at any time.

17.4

We may remove or decline to publish content that breaches these Terms. We do not remove reviews simply because they are negative.

18. Acceptable use of the Platform

18.1

You must use the Platform only for lawful purposes and in accordance with these Terms. You must not:

  • make false, speculative or fraudulent Bookings, or book on behalf of someone without their authority;
  • provide false information or impersonate another person;
  • use any robot, scraper, crawler, automated tool or AI agent to access, monitor, copy or make Bookings on the Platform without our prior written consent;
  • interfere with the security or operation of the Platform, or introduce viruses or harmful code;
  • contact Hire Partners through the Platform to arrange hire outside the Platform in order to avoid our fees; or
  • behave in an abusive, threatening or discriminatory way towards our staff or Hire Partners.

19. Fraud prevention and verification

19.1

To protect customers, Hire Partners and vehicles, we and the Hire Partner may carry out identity, driving licence, address, payment and fraud checks, including using third-party verification services and credit reference or fraud prevention agencies. Further details are in our Privacy Notice.

19.2

You must cooperate with these checks and provide any information reasonably requested. We may cancel or refuse a Booking if checks are not completed satisfactorily. Where we cancel for this reason before the hire starts, and there is no evidence of fraud, we will refund you in full.

20. Suspension and termination

20.1

If you breach these Terms or the Rental Agreement, act fraudulently, or behave unacceptably towards our staff or Hire Partners, we may suspend or close your Account, refuse future Bookings, and cancel existing Bookings.

20.2

If we cancel a Booking for these reasons, any refund will depend on the circumstances and the Hire Partner's cancellation policy. We will usually tell you why, unless the law or fraud-prevention reasons prevent us. If you think we have acted incorrectly, please contact us.

20.3

You may close your Account at any time by contacting us. Closing your Account does not cancel existing Bookings or affect amounts owed.

21. Intellectual property

21.1

The Platform and its content, including the Autofusion name, logos, design, software, text and images (other than content supplied by Hire Partners or users), belong to us or our licensors. You may use the Platform only for your own personal, non-commercial use in making and managing Bookings.

22. Our liability

22.1

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

22.2

If you are a consumer, you have legal rights in relation to services that are not provided with reasonable care and skill. Nothing in these Terms affects those rights. Advice about your legal rights is available from Citizens Advice (or Advice Direct Scotland) or your local Trading Standards office.

22.3

Our responsibility is for providing the Platform and handling your Booking and payment with reasonable care and skill. The Hire Partner, not Autofusion, is responsible for the Vehicle and the hire. We are not liable for the acts or omissions of Hire Partners, except where we have been negligent or have breached these Terms.

22.4

We are not liable for losses that were not reasonably foreseeable when you made your Booking, for losses caused by events outside our reasonable control, or for losses caused by your breach of these Terms or the Rental Agreement.

22.5

If you are a consumer, we do not exclude liability for losses arising from our breach, but we are not liable for any business losses (including loss of profit, business or opportunity), as the Platform is provided for private use.

22.6

If you book for business purposes, our total liability to you in connection with any Booking is limited to the total price paid for that Booking, and we are not liable for any indirect or consequential loss or loss of profit, business, revenue or opportunity.

23. Complaints and disputes

23.1

If you have a problem with your Booking or the Platform, please contact us at complaints@autofusionhire.co.uk, by phone on +441418990009 or by post to 2 Fitzroy place, Sauchiehall street, Glasgow, G3 7RH, with your Booking reference, a description of the problem and any supporting evidence (such as photographs, receipts or correspondence).

23.2

We will acknowledge your complaint within 2 working days and aim to respond in full within 14 days. If your complaint relates to the hire itself, we will liaise with the Hire Partner and help reach a resolution.

24. Privacy

24.1

We process your personal data as described in our Privacy Notice. We share the personal data needed to fulfil your Booking with the Hire Partner, who will process it as a separate controller under its own privacy information.

25. Changes to these Terms

25.1

We may update these Terms from time to time, for example to reflect changes in law or in how the Platform works. If we make material changes, we will notify you in advance by email or on the Platform, unless the change is required by law.

25.2

The version of these Terms in force when you made your Booking will apply to that Booking.

26. General

26.1

Events outside our control. Neither we nor the Hire Partner will be responsible for delay or failure to perform caused by events outside our reasonable control. If such an event prevents a Hire Partner from providing a Vehicle, you will be entitled to a full refund of amounts paid for the affected Booking.

26.2

Transfer. We may transfer our rights and obligations under these Terms to another organisation. We will tell you if this happens and make sure it does not reduce your rights. You may not transfer your Booking or your rights under these Terms without our written consent.

26.3

Third party rights. These Terms are between you and us. The Hire Partner may enforce the provisions of these Terms that are expressed to be for its benefit (including sections 5, 8, 12, 13 and 14). Otherwise, no other person has any right to enforce these Terms, whether under the Contract (Third Party Rights) (Scotland) Act 2017, the Contracts (Rights of Third Parties) Act 1999 or otherwise.

26.4

No waiver. If we delay in enforcing any part of these Terms, we can still enforce it later.

26.5

Language. These Terms are provided in English, and English is the language of the contract.

26.6

Notices. We will contact you using the email address or telephone number in your Account. You can contact us using the details in section 28.

27. Governing law and jurisdiction

27.1

These Terms, and any dispute or claim arising out of or in connection with them, are governed by Scots law.

27.2

If you are a consumer, you may bring proceedings in the Scottish courts. If you live in England and Wales, you may also bring proceedings in the courts of England and Wales, and if you live in Northern Ireland, in the courts of Northern Ireland. You keep the benefit of any mandatory consumer protection laws of the part of the UK where you live.

27.3

If you book for business purposes, the courts of Scotland have exclusive jurisdiction.
